OSHA Releases Fall 2020 Regulatory Agenda
The Occupational Safety and Health Administration (OSHA) has released its fall regulatory agenda but things are likely to change when the Biden administration takes office.
Three rules are currently in the final stage. These include:
- Procedures for the Handling of Retaliation Complaints Under the Taxpayer First Act
- Procedures for Handling of Retaliation Complaints Under the Whistleblower Protection Statutes
- Discrimination Against Employees Exercising Rights Under the Williams-Steiger Occupational Safety and Health Act of 1970
Changes Ahead
Employers can expect a greater focus on employee protections under Biden, including a more aggressive approach to workplace inspections and employer penalties. Many foresee one of the first actions when Biden takes office being the issuance of a federal COVID-19 emergency temporary standard, similar to the standards already enacted in some states, including Michigan, Virginia and Oregon.
